1. Agreement to these Terms
1.1 These Terms of Service ("Terms") are a binding agreement between you and Lymphoa Group LLC, a Wyoming limited liability company doing business as Oakpaw ("Oakpaw," "we," "us," or "our"). They govern your use of oak-paw.com, our checkout, The Paw Club, the Member Library, our emails, and all products and content we provide (together, the "Services").
1.2 By placing an order, joining The Paw Club, creating an account, or checking a box or clicking a button that refers to these Terms, you agree to these Terms, our Refund Policy, our Digital Delivery Policy, and our Privacy Policy, which are part of these Terms. If you do not agree, do not use the Services.
1.3 Joining The Paw Club is always a separate, optional choice. Agreeing to these Terms at checkout does not enroll you in The Paw Club. You become a member only if you actively choose The Paw Club free trial as described in Section 9.2.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to make a purchase or join The Paw Club. The Services are intended for customers in the United States. You must use a payment method you are authorized to use.
3. Your account
3.1 You may need an account to access the Member Library. You agree to give accurate information and keep it up to date, keep your password confidential, and tell us right away at support@oak-paw.com if you think someone has used your account without permission.
3.2 You are responsible for all activity under your account, except activity caused by our own error.
4. Products, prices, and offers
4.1 Digital and physical products. Our cookbooks are digital e-books delivered as PDF files; they are not shipped. We also sell physical products for dogs, which are shipped to the United States and Canada (Section 21). Product descriptions, sample pages, and page counts on our website describe the content you receive.
4.2 Prices. Prices are shown in U.S. dollars. The price of each e-book is shown on its product page and at checkout. Applicable sales tax, if any, is calculated and shown at checkout before you pay.
4.3 Bonus items. Some offers include free bonus items, such as a 4-week meal plan and printable templates. Bonus items are only available with the specific offer they are advertised with, have no cash value, and are delivered together with the product they come with.
4.4 Errors. If a product is listed at an incorrect price because of a clear error, we may cancel the order and refund any amount charged for it. We will tell you if this happens.
4.5 Promotions are subject to the terms shown with them and may end at any time.
4.6 Paw Club member prices. Members of The Paw Club receive a 20% member discount and free U.S. shipping on physical products under Sections 9.13 and 9.14. Member prices are shown at checkout before you pay.
5. Orders and payment
5.1 Payment processing. Payments are processed by our payment processor, Paysight. By submitting payment, you confirm that you are authorized to use the payment method and you authorize us and Paysight to charge it for the total shown at checkout.
5.2 Statement descriptor. Charges from us appear on your card statement as OAKPAW. If you do not recognize a charge, please contact support@oak-paw.com before contacting your bank.
5.3 Order confirmation. After payment, we show a confirmation page and send a confirmation email to the address you entered. Please enter your email address correctly. Your download links, receipts, and membership notices are sent there.
5.4 Fraud prevention. We and Paysight may screen orders for fraud and may cancel or refuse an order we believe is fraudulent or unauthorized.
6. Digital delivery
Digital products are delivered as soon as your payment is confirmed and your order confirmation email with your download links is sent. Your download links arrive in your order confirmation email within minutes. Keep the email — the links stay active. If it doesn't arrive or a file won't open, email support@oak-paw.com and we'll resend it. Details are in our Digital Delivery Policy.
7. License to use our digital content
7.1 All e-books, recipe packs, meal plans, printables, Member Library content, and other digital content ("Content") are owned by Oakpaw or our licensors and are protected by copyright and other laws. You do not buy the copyright. You buy a license to use the Content.
7.2 Personal use license. When you buy a product or receive Content as a Paw Club member, we grant you a limited, non-exclusive, non-transferable, revocable license to download, view, and print the Content for your own personal, non-commercial use in your household.
7.3 You may not:
- share, forward, upload, post, sell, resell, rent, lend, or give away the Content or your download links, in whole or in part;
- share your Member Library login with anyone outside your household;
- use the Content for any commercial purpose, including in a dog food, pet care, or other business;
- copy, modify, translate, or create derivative works for distribution, or remove copyright notices;
- use the Content to train artificial intelligence or machine learning models, or scrape the Services.
7.4 Keeping your downloads. Content you have downloaded remains licensed to you for personal use after your purchase or membership ends, unless we terminate your license because you violated these Terms. Access to the online Member Library ends when your membership ends.
8. Health and safety notice — no veterinary advice
8.1 OUR CONTENT IS FOR GENERAL INFORMATION ONLY. IT IS NOT VETERINARY ADVICE AND DOES NOT REPLACE THE ADVICE, DIAGNOSIS, OR TREATMENT OF A LICENSED VETERINARIAN. Every dog is different.
8.2 Talk to your veterinarian before changing your dog's diet, especially if your dog is a puppy, a senior, pregnant or nursing, overweight, has allergies or food sensitivities, or has any medical condition (for example kidney, liver, pancreatic, digestive, or heart conditions) or takes medication.
8.3 Unless a recipe specifically states otherwise, our recipes are not designed as the sole, complete, and balanced long-term diet for your dog. Introduce new foods gradually, follow the portion guidance, and watch your dog for any reaction. Stop feeding a recipe and contact your veterinarian if your dog shows signs of illness.
8.4 Always follow safe food handling and storage practices. Some foods that are safe for people are toxic to dogs (for example chocolate, grapes, raisins, onions, garlic, xylitol, macadamia nuts). Only use ingredients as written, and check each ingredient against your dog's needs and allergies.
8.5 You are responsible for decisions about your dog's diet and health. To the fullest extent permitted by law, we are not responsible for any illness, injury, allergic reaction, or other harm to any animal or person arising from the use of our Content.
9. THE PAW CLUB MEMBERSHIP TERMS
These membership terms apply if you join The Paw Club. They are part of these Terms. If anything in this Section 9 conflicts with other parts of these Terms, this Section 9 controls for The Paw Club.
9.1 What The Paw Club includes
While your membership is active (including during your free trial), you receive:
- a new cookbook every month, delivered as a downloadable PDF e-book;
- access to the complete Member Library, our online collection of Oakpaw cookbooks, recipes, and resources for members;
- a 20% member discount on all products in our shop, applied automatically at checkout (Section 9.13);
- free shipping on physical products to addresses within the United States (Section 9.14);
- early access to new products before they are available to everyone (Section 9.15); and
- members-only gifts from time to time (Section 9.15).
The specific cookbooks, recipes, and resources may change from month to month. During your free trial you have the same benefits as a paying member. The rules in Section 9.16 apply to all member benefits.
9.2 How you join — your choice, your consent
The Paw Club is optional. You do not need to join to buy any product. You can join in one of two ways:
(a) At checkout, by actively checking the box labeled with The Paw Club free trial terms. This box is never checked in advance. If you leave it unchecked, you are not enrolled.
(b) After your purchase, on our separate Paw Club offer page, by clicking the button "Start my free trial." If you click "No thanks," you are not enrolled.
The price, trial length, renewal terms, and how to cancel are shown to you right next to the checkbox or button before you agree. By checking the box or clicking the button, you give your express consent to these membership terms, including the automatic monthly renewal and charges described below.
9.3 Free trial
(a) Your free trial lasts 14 days and starts at the moment you join (the "Trial Start"). Your trial ends 14 days after the Trial Start (the "Trial End"). The exact Trial End date is shown at sign-up, on your confirmation page, in your confirmation email, in your reminder email, and in your account.
(b) No charge during the trial. We do not charge any membership fee during the free trial. When you join, we verify your card with a $0.00 account verification. This is not a charge. If your card cannot be verified, your free trial does not start and we will tell you.
(c) One free trial per person. Free trials are limited to one per person, household, email address, and payment method. If you have already had a Paw Club free trial, we may start your new membership as a paid membership without a free trial; if so, we will tell you this before you agree.
(d) Cancel during the trial and pay nothing. If your cancellation reaches us before the Trial End, you will not be charged any membership fee. Your Member Library access continues until the Trial End.
9.4 PRICE AND AUTOMATIC RENEWAL
UNLESS YOUR CANCELLATION REACHES US BEFORE YOUR TRIAL END, YOUR FREE TRIAL WILL AUTOMATICALLY CONVERT INTO A PAID MONTHLY MEMBERSHIP. YOU AUTHORIZE US TO CHARGE YOUR PAYMENT METHOD $29.90 ON THE TRIAL END DATE AND AGAIN EVERY MONTH AFTER THAT ON THE SAME DAY OF THE MONTH, UNTIL YOU CANCEL.
(a) Price: $29.90 per month, plus applicable sales tax, if any, as shown before you agree.
(b) Billing date: Your first charge is on your Trial End date. After that, you are charged every month on the same day of the month (your "Billing Date"). If a month has no such day (for example, the 31st), you are charged on the last day of that month.
(c) Continuous membership: Your membership continues month to month until you cancel or we end it under these Terms. There is no minimum term and no cancellation fee.
9.5 Payment method and stored card
(a) You authorize us and Paysight to store your payment method and to use it for the recurring Paw Club charges described above until you cancel. We will not use your stored payment method for any other charge unless you confirm that charge.
(b) If your card is replaced or updated, your card issuer or network may give us the updated card details, and we may use them for your membership.
(c) Failed payments. If a charge fails, we will email you and give you at least 7 days to update your payment method or pay another way. During that time we may try to charge your payment method again. If we still cannot collect payment, we may pause or end your membership. If you cancel, we stop all further attempts. You remain responsible for any charge that was successfully authorized before you cancelled.
9.6 Notices we send you
We send these emails to the address you gave us. They are transactional messages, so you receive them even if you unsubscribe from marketing emails:
- Membership confirmation right after you join, with these terms, your Trial End date, the price, and your cancellation link;
- Trial reminders: one at least 7 days before your Trial End and a second one about 4 days before your Trial End, each with the date and amount of your first charge and a link to cancel online;
- Receipt after every charge, with the amount, date, and your cancellation link, and a notice if a charge is declined;
- Payment failure notice if a charge fails;
- Price change notice before any price change (Section 9.9);
- Annual reminder at least once a year with your membership terms and how to cancel;
- Cancellation confirmation within 1 business day after your cancellation reaches us.
Please add support@oak-paw.com to your contacts so our emails reach your inbox.
9.7 HOW TO CANCEL
You can cancel at any time with one email. You do not need to call us or give a reason. Use any one of these methods:
- Cancellation email button: Click "Cancel my membership" on our cancellation page at oak-paw.com/cancel or in any Paw Club email. The button opens a ready-made email to support@oak-paw.com with the subject "Cancel my Paw Club membership." Just send it. If you send it from a different email address than the one you used to join, add your membership email address.
- Online, in one step: Use the short form on oak-paw.com/cancel (enter your email address and click "Send my cancellation"), the "cancel online" link in any Paw Club email, or the "Cancel membership" button in your account. Online cancellations are confirmed on screen right away.
- Your own email: Write to support@oak-paw.com, or reply to any Paw Club email from us, and tell us you want to cancel. Any message that clearly asks us to cancel counts.
If your bank or card issuer offers a way to cancel recurring payments in its banking app and tells us about your cancellation, we treat it as a cancellation of your membership.
(a) Effective when it reaches us. Your cancellation takes effect at the moment your email or online cancellation reaches us, and we stop all future charges from that moment. If we need to confirm which membership is yours, your cancellation still counts from the time your first message reached us.
(b) Charges after cancellation are refunded. If a charge is made after your cancellation reached us, we refund it in full, without you having to ask.
(c) Confirmation within 1 business day. We confirm every cancellation by email within 1 business day. Please keep this confirmation. If you do not receive it within 1 business day, please check your spam folder and contact support@oak-paw.com again.
(d) No hurdles. We do not require a phone call, a login, a reason, or a survey to cancel, and we do not ask you to accept or reject any offer before we process your cancellation. After your cancellation has been processed, we may tell you about an optional offer; you do not need to respond to it.
(e) What happens after you cancel. Cancelling stops all future charges. You keep access to the Member Library until the end of the period you have already paid for (or, during the free trial, until the Trial End). After that, your Member Library access ends. Content you have downloaded remains licensed to you for personal use (Section 7.4). Your shop benefits — the 20% member discount, free U.S. shipping, early access, and members-only gifts — end at the moment your cancellation reaches us (Section 9.16(d)).
(f) Unsubscribing from marketing emails or simply not using the membership does not cancel it. Please use one of the methods above.
9.8 NO REFUNDS
MEMBERSHIP FEES ARE NON-REFUNDABLE. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR PARTIAL MONTHS, UNUSED MEMBERSHIP TIME, OR MONTHS IN WHICH YOU DID NOT USE THE SERVICE. CANCELLING STOPS FUTURE CHARGES; IT DOES NOT REFUND PAST CHARGES.
This does not apply to: (i) a billing error by us, such as a duplicate charge, a charge in the wrong amount, or a charge made after your cancellation took effect, which we will refund; or (ii) any refund required by applicable law. We may choose to offer a refund or credit in a particular case as a courtesy; doing so does not oblige us to do so again. See our Refund Policy.
9.9 Price changes
We may change the membership price in the future. We will email you about any price change in advance, at least 14 days and no more than 30 days before it takes effect, with the new price, the date it applies, and how to cancel. If you do not want to pay the new price, you can cancel before it takes effect. The new price never applies to a billing period you have already paid for. If you cancel within 14 days after the first charge at a higher price, we will refund the unused portion of that charge.
9.10 Changes to Club content and benefits
We regularly update the Member Library. We may add, change, or remove individual recipes or resources. If we make a change that materially reduces what The Paw Club includes, including any member benefit in Sections 9.13–9.15, we will tell you by email at least 14 days and no more than 30 days in advance, and you can cancel before the change takes effect.
9.11 Personal membership; no account sharing; misuse
(a) Your membership is for you and your household only. Do not share your login, your download links, or Club Content with anyone outside your household, and do not post Club Content online.
(b) Misuse includes: sharing or reselling access or Content; using automated tools to download Content in bulk; signing up repeatedly with different emails, names, or payment methods to get more than one free trial; using a payment method you are not authorized to use; and filing false payment disputes.
(c) If you misuse The Paw Club, we may suspend or end your membership and your license to Content with immediate effect. In that case, no refund is due.
(d) If we end The Paw Club or your membership for any other reason (not because of your misuse), we will tell you in advance where possible, and we will refund the unused portion of your current paid month.
9.12 Records of your consent
We keep a record of your consent to these membership terms, including the text shown to you, the state of the checkbox or the button you clicked, the date and time, your IP address, and your device and browser data, together with records of the emails we send you and your access to Club Content. We keep these records for at least 3 years after your membership ends. You can ask us for a copy of your consent record and these terms at any time.
9.13 Member discount — 20% off in our shop
(a) While your membership is active, including during your free trial, you receive 20% off the price of all products sold in our shop, both digital and physical, on orders you place after your membership starts.
(b) Applied automatically. The discount is deducted automatically at checkout when you are signed in to your member account or check out with the email address of your membership, and it is shown in the order summary before you pay. If you do not see the member discount in your order summary, please do not complete your purchase and contact support@oak-paw.com. We cannot apply the discount to an order after it has been placed, unless the discount was missing because of an error on our side.
(c) Combinable with other offers. The member discount applies in addition to other offers, bundle prices, and discount codes, unless an offer clearly states otherwise. It is calculated on the price after any other discount.
(d) Exclusions. The member discount does not apply to Paw Club membership fees, shipping charges (see Section 9.14 for member shipping), or taxes.
(e) Personal use. The discount is for purchases for you and your household. It may not be used for resale or other commercial purposes, or to buy on behalf of people who are not members.
9.14 Free shipping on physical products (United States only)
(a) While your membership is active, including during your free trial, standard shipping on physical products is free for orders shipped to addresses within the United States. Free member shipping is shown at checkout before you pay.
(b) Orders shipped outside the United States, and faster shipping methods you choose at checkout, are charged at the regular shipping rates.
(c) Free member shipping does not cover return shipping. Returns are governed by the "Physical Products" section of our Refund Policy.
9.15 Early access and members-only gifts
(a) Early access. We may let members see and buy new products before they are available to everyone. Early access does not guarantee that a product is available or in stock.
(b) Members-only gifts. From time to time, we may offer gifts only for members, for example bonus recipe packs or free items with an order. Each gift is subject to the conditions shown with it and is available while supplies last. Physical gifts are shipped only within the United States.
9.16 Rules for all member benefits
(a) No cash value. Member benefits, including the member discount, free shipping, early access, and members-only gifts, have no cash value and cannot be redeemed, exchanged, or paid out for cash, credit, or store credit.
(b) Not transferable. Member benefits are personal to you. They cannot be transferred, sold, shared, or given to anyone else.
(c) No set-off against claims. Member benefits cannot be set off against, credited toward, or used to increase or calculate any refund, chargeback, damages, or other claim, whether brought individually, collectively, or as a class. Any refund we issue for an order is based on the amount you actually paid for that order. No part of the membership fee is allocated to any individual benefit, and no refund or credit is due for benefits you did not use.
(d) Benefits end when you cancel. The member discount, free member shipping, early access, and members-only gifts end at the moment your cancellation reaches us, even if your Member Library access continues until the end of the period you have already paid for. They also end when your membership otherwise ends. Orders placed after that are charged at regular prices and shipping rates.
(e) Misuse. If member benefits are misused (for example for resale, by sharing a member account, or by creating several memberships), we may cancel the affected orders, charge the regular price for them with your consent, or end your membership under Section 9.11.
10. Your use of the Services
You agree not to: break any law; infringe anyone's rights; interfere with or disrupt the Services; try to access accounts, systems, or data you are not authorized to access; use bots, scrapers, or other automated tools; upload viruses or harmful code; or use the Services to send spam.
11. Intellectual property
The Services, including the Oakpaw name and logo, website design, text, photos, recipes, and other Content, are owned by Oakpaw or our licensors. Except for the license in Section 7, these Terms do not give you any rights to our intellectual property.
12. Reviews and feedback
If you send us reviews, comments, photos, or suggestions, you give us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display them in connection with our business, and you confirm that you have the right to give us this license. We will not use your full name or photo in advertising without your permission.
13. Third-party services
The Services may use or link to services provided by third parties, such as our payment processor. We are not responsible for third-party services, and your use of them may be subject to their own terms.
14. DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT PROMISE ANY PARTICULAR RESULT FOR YOUR DOG'S HEALTH, WEIGHT, BEHAVIOR, OR WELL-BEING, AND WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
15. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (1) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (2) $50.
These limits apply to any theory of liability, even if we were told that such damages were possible. They do not limit liability that cannot be limited under applicable law. Some states do not allow these limitations, so they may not fully apply to you.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Oakpaw, Lymphoa Group LLC, and its members, managers, employees, and agents from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services or Content.
17. Billing questions, disputes, and chargebacks
17.1 Please contact us first. If you have a question or a problem with a charge, email support@oak-paw.com before you contact your bank or card issuer. Most problems, such as a missing download or a charge you do not recognize, can be solved quickly by us. We correct billing errors promptly.
17.2 If you dispute a charge with your bank, we will provide your card issuer, the card networks, and our payment processor with the records of your transaction, including your consent record, the emails we sent you, and the record of when we sent your download links (see Section 9.12 and our Privacy Policy). If a dispute is resolved in our favor, the charge remains due.
17.3 While a dispute is open, we may suspend your membership and access to Content. If a dispute is filed for a charge you authorized, we may end your membership and license to Content.
17.4 Nothing in these Terms limits any right you have under applicable law to dispute a charge with your card issuer.
18. DISPUTE RESOLUTION — BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES BY INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND IT LIMITS HOW YOU CAN SEEK RELIEF. YOU CAN OPT OUT (SECTION 18.8).
18.1 Informal resolution first. Before starting arbitration or a court case, you and we agree to try to resolve any dispute informally. The party with a claim must send a written notice to the other ("Notice of Dispute") that includes the name, email address, and order number (if any) of the person making the claim, a description of the dispute, and the relief requested. Send your Notice of Dispute to support@oak-paw.com with the subject line "Notice of Dispute," or by mail to Lymphoa Group LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA. We will send ours to the email address associated with your order or account. If the dispute is not resolved within 60 days after the notice is received, either party may start arbitration. During this period, any statute of limitations is paused.
18.2 Agreement to arbitrate. Except as stated in Section 18.6, you and Oakpaw agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, your purchases, The Paw Club, our communications with you, or our privacy practices (each a "Dispute"), will be resolved by binding individual arbitration, not in court. This includes Disputes about the scope, validity, or enforceability of this arbitration agreement, which the arbitrator decides, except as stated in Sections 18.4 and 18.9.
18.3 Rules and procedure. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, as modified by this Section 18. The rules are available at www.adr.org. The arbitration will be held in the county where you live or by video or telephone, unless both parties agree otherwise. For claims of $10,000 or less, the arbitration will be decided on written submissions only, unless the arbitrator requests a hearing. Payment of filing and arbitration fees will be governed by the AAA Consumer Arbitration Rules. The arbitrator may award the same individual relief a court could award under applicable law, and the award may be entered in any court with jurisdiction.
18.4 CLASS ACTION AND JURY TRIAL WAIVER. YOU AND OAKPAW AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND OAKPAW EACH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may not consolidate more than one person's claims and may award relief only in favor of the individual party seeking relief and only to the extent needed to provide relief for that party's individual claim. A court, not an arbitrator, decides any dispute about the enforceability of this Section 18.4.
18.5 Mass filings. If 25 or more similar Disputes are filed against us or by us by the same or coordinated counsel or organizations, the AAA's Mass Arbitration Supplementary Rules will apply in addition to its Consumer Arbitration Rules. The parties will cooperate in good faith with the AAA to resolve such Disputes efficiently and cost-effectively. Nothing in this Section 18.5 prevents any individual claim from being heard, and any statute of limitations is paused while a Dispute is pending under this Section.
18.6 Exceptions. Either party may: (a) bring an individual claim in small claims court if it qualifies and stays there; and (b) ask a court for an injunction to stop the infringement or misuse of intellectual property rights.
18.7 Public injunctive relief. If applicable law does not allow a request for public injunctive relief to be waived or arbitrated, that request (and only that request) will be decided by a court after the individual arbitration is complete, and the court case will be paused until then.
18.8 30-DAY RIGHT TO OPT OUT. You may opt out of this arbitration agreement by sending us written notice within 30 days after you first accept these Terms (for example, by placing your first order). Send your opt-out notice to support@oak-paw.com with the subject line "Arbitration Opt-Out," or by mail to the address in Section 18.1. Include your name, the email address you used with us, and a clear statement that you want to opt out of arbitration. Opting out does not affect any other part of these Terms. If you opt out, Section 19 still applies.
18.9 Severability. If the class action waiver in Section 18.4 is found unenforceable for any claim, then that claim (and only that claim) must be decided in court under Section 19, and not in arbitration. If any other part of this Section 18 is found unenforceable, the rest of it remains in effect.
18.10 Changes. If we change this Section 18 after you accepted it, you may reject the change by emailing us within 30 days after the change takes effect. In that case, the version of this Section 18 you last accepted continues to apply to you.
18.11 Survival. This Section 18 survives the end of your purchase, membership, and these Terms.
19. Governing law and venue
These Terms and any Dispute are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules, and, for Section 18, by the Federal Arbitration Act. This choice of law does not deprive you of the protection of mandatory consumer protection laws of the state where you live. Any Dispute that is not subject to arbitration will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, unless the law of your state requires otherwise, and you and we consent to their jurisdiction.
20. Electronic communications and signatures
You agree that we may provide all agreements, notices, receipts, disclosures, and other communications to you electronically, by email or on our website, and that electronic communications satisfy any legal requirement that they be in writing. Your click on a checkbox or button, together with our records of it, is your electronic signature and has the same effect as a signature on paper. You can print or save these Terms and any email we send you. To receive our communications, you need an email account and a device that can open web pages and PDF files. To update your email address, contact support@oak-paw.com.
21. Physical products
21.1 Where we ship. We ship physical products to addresses in the United States and Canada. Orders are packed and shipped by our fulfillment partner.
21.2 Processing and delivery. Orders ship within 1–3 business days and usually arrive 1–3 business days after shipping. You'll get tracking by email. Delivery times are estimates. Details are in our Shipping & Digital Delivery Policy.
21.3 Shipping costs. U.S. standard shipping is $4.95 per order and free on orders of $35 or more (product subtotal after discounts, before tax). Paw Club members receive free standard shipping within the United States under Section 9.14. For Canada, shipping rates are shown at checkout. The shipping cost is always shown at checkout before you pay.
21.4 Shipping delays. If we cannot ship your order within the stated processing time, we will notify you by email with a revised shipping date and your right to cancel the order for a full refund, as described in our Shipping & Digital Delivery Policy.
21.5 Lost and undelivered packages. If your order does not arrive or is lost, please contact us within the time limits in our Shipping & Digital Delivery Policy (Section 6.7). If a package is confirmed lost, we send a replacement or refund the price of the missing items.
21.6 Title and risk of loss. Title to physical products passes to you when we hand them to the carrier. This does not limit our commitments for lost or damaged packages in Section 21.5 and in our Refund Policy.
21.7 Returns and refunds. You may return unused and unopened products in their original packaging within 7 days after delivery. Used items cannot be returned for hygiene reasons. Damaged, defective, or wrong items are replaced or refunded. The full rules are in the "Physical Products" section of our Refund Policy. The non-refundable rules for digital products and Paw Club fees do not apply to physical products.
21.8 Product information. We describe our products and show their sizes and colors as accurately as we can. Colors may look slightly different on your screen, and sizes may vary slightly. Please check the size information on the product page before you order.
21.9 Product safety. Follow all instructions and warnings that come with a product. Supervise your dog when using any product, check products regularly for wear and damage, and stop using a product that is damaged. Our products are not chew toys unless the product page says so.
21.10 Paw Club. Physical products are not included in the Paw Club membership fee. Members receive the member discount and free U.S. shipping on them under Sections 9.13 and 9.14.
22. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last updated" date. If a change is material, we will notify you by email or on the website before it takes effect. Changes do not apply retroactively. Changes to The Paw Club price follow Section 9.9. Continued use of the Services after a change takes effect means you accept the updated Terms. If you do not agree, you can stop using the Services and cancel your membership.
23. General terms
23.1 Entire agreement. These Terms, together with the policies referred to in them, are the entire agreement between you and us about the Services.
23.2 Severability. If any part of these Terms is found unenforceable, the rest remains in effect (subject to Section 18.9).
23.3 No waiver. Our failure to enforce any part of these Terms is not a waiver.
23.4 Assignment. You may not transfer your rights under these Terms. We may transfer our rights and obligations to a successor or affiliate, and we will notify you if this affects your membership.
23.5 Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.
23.6 Headings are for convenience only. "Including" means "including without limitation."
23.7 Survival. Sections 7, 8, 9.8, 9.12, 9.16, and 11 through 23 survive the end of these Terms.
